On September 18, 2012, the Pennsylvania Supreme Court by a 4-2 vote vacated the order of the Commonwealth Court in the Voter ID Applewhite litigation. The Supreme Court remanded the case back to Commonwealth Court for an assessment of 1) whether the state’s efforts in issuing alternate ID cards comport with the requirement of “liberal access,” and 2) in its predictive judgment, whether there will be voter disenfranchisement in the November election as a result of the Voter ID requirement.
